一 | New Delhi, Oct 11 (UNI) The Competition Commission of India (CCI) has issued cease and desist order against 8 firms found guilty of bid rigging and cartelization in tender floated by Eastern Railway, an official statement said on Tuesday.
The case was initiated on the basis of a reference filed on behalf of the Eastern Railway.
CCI found the firms to have indulged in cartelization in the supply of axle bearings to Eastern Railway by means of directly or indirectly determining prices, allocating tenders, coordinating bid prices and manipulating the bidding process.
The evidence in the matter included e-mails, call detail records and the statements of the representatives of the firms, the statement said.
The e-mails exchanged showed that the firms allegedly discussed quantity allocation with respect to the tenders of Indian Railways for the procurement of Axle Bearings amongst themselves.
"The vendors were also found to have discussed the compensation mechanism in the event that some of them did not win the agreed quantities," the statement said.
Of the eight entities, two were lesser penalty applicants before the CCI.
" Under Section 46 of the Act, a cartel member may approach the Commission by way of filing an application seeking lesser penalty, in return for providing full, true and vital disclosures in respect of the alleged cartel to the Commission. In this backdrop, CCI found eight firms guilty of bid rigging and cartelization in tender floated by Eastern Railway during the years 2015 to 2019," the statement.
However, CCI refrained from imposing any monetary penalty considering the firms were MSMEs with limited staff and turnover, the cooperative and non-adversarial approach adopted by firms in acknowledging their involvement as well as the economic stress wrought upon the MSME sector in the wake of COVID-19, the statement added.
UNI AKM GNK。 राज्य ब्यूरो, लखनऊ। घाटे में चल रहीं प्रदेश की बिजली कंपनियों ने प्राइवेट संस्था आल इंडिया डिस्कॉम एसोसिएशन को सदस्यता और चंदे के रूप में 1.30 करोड़ से अधिक दिए हैं। सदस्यता व चंदे की सूचना मिलने के बाद बुधवार को बिजलीकर्मियों के संगठनों और उपभोक्ता परिषद ने उत्तर प्रदेश पावर कारपोरेशन प्रबंधन को कटघरे में खड़ा किया। विद्युत उपभोक्ता परिषद ने सरकारी बिजली कंपनियों द्वारा निजी संस्था को सदस्यता और चंदे के रूप में इतनी बड़ी धनराशि दिए जाने पर विद्युत नियामक आयोग में याचिका दायर कर प्रकरण की जांच कराने की मांग की है। उपभोक्ता परिषद के अध्यक्ष अवधेश कुमार वर्मा ने नियामक आयोग में दायर याचिका में कहा है कि पावर कारपोरेशन के अध्यक्ष डॉ. आशीष गोयल इस प्राइवेट संस्था के महासचिव हैं। उन्होंने अपने पद का दुरुपयोग किया है। पावर कारपोरेशन के पूर्व अध्यक्ष व ऊर्जा सचिव रह चुके आलोक कुमार इस संस्था के महानिदेशक हैं। लिखा है कि प्रदेश के उपभोक्ताओं से वसूली जा रही बिजली बिल की धनराशि से किसी प्राइवेट संस्था को करोड़ों रुपये चंदा देना असंवैधानिक है। इस मामले की सीबीआई जांच कराई जानी चाहिए।,याचिका के माध्यम से आयोग को बताया है कि तीन जून को पावर कारपोरेशन के साथ ही पांचों विद्युत वितरण कंपनियों ने इस संस्था को सदस्यता व चंदे के रूप में 1,30,80000 रुपये दिए। सभी बिजली कंपनियों ने अलग-अलग 21.80 लाख रुपये संस्था को दिए हैं। यह भुगतान उपभोक्ताओं से वसूले गए राजस्व में से किया गया है।भुगतान करने के लिए नियामक आयोग से कोई अनुमति नहीं ली गई है। सवाल खड़ा किया है कि सरकारी क्षेत्र की बिजली कंपनियां किसी प्राइवेट संस्था को सरकारी राजस्व से चंदा कैसे दे सकती हैं। आयोग से मांग की है कि इस खर्च का भार प्रदेश के विद्युत उपभोक्ताओं पर ना पड़े, जो भी जिम्मेदार हैं उनके खिलाफ कार्रवाई की जाए। ,इस मामले में पावर कारपोरेशन अध्यक्ष से स्पष्टीकरण भी लिया जाए। वहीं इस प्रकरण पर पूछे जाने पर पावर कारपोरेशन के अध्यक्ष डॉ. आशीष कुमार गोयल ने कुछ भी बोलने से इनकार किया। सीएम से मामले की उच्चस्तरीय जांच कराने की मांग विद्युत कर्मचारी संयुक्त संघर्ष समिति ने मुख्यमंत्री योगी आदित्यनाथ से मांग की है कि आल इंडिया डिस्कॉम एसोसिएशन के गठन से लेकर पावर कारपोरेशन और विद्युत वितरण निगमों द्वारा एसोसिएशन को चंदा दिए जाने के मामले की उच्च स्तरीय जांच कराई जाए। ,हितों के टकराव को देखते हुए पावर कारपोरेशन के अध्यक्ष आशीष गोयल को निर्देश दिया जाए कि वे डिस्कॉम एसोसिएशन महामंत्री का पद छोड़ दें नहीं तो उन्हें पावर कारपोरेशन अध्यक्ष के पद से हटाया जाए। समिति ने बताया है कि पावर कारपोरेशन ने एसोसिएशन की सदस्यता के लिए जीएसटी मिलाकर 11.80 लाख रुपये का भुगतान किया है। सहयोग (चंदे) के रूप में 10 लाख रुपये का भुगतान अलग से किया है।。
